S.B. 10-71: Create Seniors Lifetime State Parks Pass

The act creates the aspen leaf lifetime pass (lifetime pass), which allows its holder entry into state parks and recreation areas for the duration of the holder's lifetime. The lifetime pass will be available for purchase by a state resident who meets the age of eligibility set by the board of parks and outdoor recreation (board) for the aspen leaf annual pass. The board will set by rule the manner in which the lifetime pass shall be displayed and the amount of the fee for the lifetime pass, not to exceed five times the amount of the aspen leaf annual pass.

Current laws regarding the use and suspension of the aspen leaf annual pass are applied to the lifetime pass.

The lifetime pass shall not be sold on or after March 1, 2014. Prior to that date, the department of natural resources (department) is required to report to the senate agriculture and natural resources committee and the house agriculture, livestock, and natural resources committee regarding the lifetime pass.

For implementation of the act, $8,800 is appropriated from the parks and outdoor recreation cash fund to the division of parks and outdoor recreation in the department.

H.B. 09-1198: Uniform Power of Attorney Act

Enacts the "Uniform Power of Attorney Act" (UPOAA) to govern powers of attorney granted by individuals. Excludes certain powers of attorney from the UPOAA. Sets forth a form that may be used to create a statutory form for a power of attorney.

Specifies:

  • On January 1, 2010, the UPOAA applies to a power of attorney created before, on, or after January 1, 2010.
  • When a power of attorney existing on December 31, 2009, is durable and when a power of attorney created on or after January 1, 2010, is presumed durable.
  • When the UPOAA applies to a judicial proceeding concerning a power of attorney.
  • That an act done before January 1, 2010, is not affected by the UPOAA.

Effective January 1, 2010:

  • Makes conforming amendments to part 6 of article 14 of title 15, Colorado Revised Statutes, so part 6 only applies to a power of attorney executed by entities.
  • Repeals the "Uniform Statutory Form Power of Attorney Act", part 13 of article 1 of title 15, Colorado Revised Statutes.

H.B. 09-1241: Probate Code Omnibus

Enacts the "Uniform Principal and Income Act of 1955" (1955 act) as it existed at the time of the adoption of the "Uniform Principal and Income Act of 2000" (2000 act). Limits the applicability of the 1955 act to trusts and other interests that are not subject to the 2000 act. Applies the 1955 act retroactively for life estates for which there is no applicable law for the interim from the adoption of the 2000 act to the present. Allows the holders of such life estates to elect against the applicability of the 1955 act. Amends provisions of the 1955 act and the 2000 act concerning the disposition of natural resources.

Amends provisions concerning the entry by a representative of a custodian into a safe deposit box of a decedent.

Amends provisions concerning the duty of a personal representative to take possession or control of the estate of a decedent.

Amends provisions concerning the appointment of a guardian for a minor child by means of a signed writing.

Allows a court to appoint a guardian ad litem to represent the interest of a protected person if the court determines that a need for such representation exists.

Enacts the "Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act". Specifies the jurisdictional rules and the rules relating to cooperation and communication between courts of different states.

S.B. 08-131: Old Age Pension Medical Program

For any state fiscal year commencing on or after July 1, 2009, increases the amount allocated to the supplemental old age pension health and medical care fund from the receipts collected from the state sales and use tax by $2,100,000. Decreases the allocation to the general fund by an equal amount.

H.B. 07-1100: Increase Funds for Older Coloradoans Cash Fund

In all future state fiscal years, increases the allocation of state sales and use tax receipts to the older Coloradans cash fund from $3 million to $5 million. Makes a corresponding decrease of $2 million in the allocation to the general fund.
